Violation A caregiver was not knowledgeable of the needs of children as evidenced by upon arrival at 4:25pm, Ms. Kristina was observed trying to get a game started while standing at a sheet of poster paper on the wall. All 7 children present were observed sitting at the tables and looking at Ms. Kristina, talking quietly, and did not appear to be misbehaving. At 4:31pm, Ms. Kristina required all 7 children present, ages 5-8 years old, to sit in time-out for 10 minutes with their heads down on tables and instructed them not to talk. Ms. Kristina set the timer on her phone and told the children, "If one person talks, the time will increase to 15 minutes for the whole group". One child started crying during the time out and Ms. Kristina told that child "What's wrong with you? You don't like doing this? This could all be over if you could learn to listen." Ms. Taylor (the person in charge due to the Director's absence) observed the entire interaction and did not intervene. When asked if staff were aware of the licensing rules regarding the discipline and length of time for time out, Ms. Taylor stated that she thought the rule was that staff just shouldn't be too extreme with time out. Licensing Rule Reference 19 CSR 30-62.102 Personnel (1) (H) states: The provider shall have available a copy of the Licensing Rules for Group Day Care Homes and Child Day Care Centers in Missouri. All caregivers and volunteers working directly with children shall be required to review and be knowledgeable of the rules at the time they begin work and shall be able to understand and apply those rules which relate to their respective responsibilities. Licensing Rule Reference 19 CSR 30-62.102 Personnel (1) (K) states: Volunteers counted in staff/child ratios, caregivers, and other personnel shall be screened for child abuse/neglect. The screening shall be requested by the provider within ten (10) days of any individual beginning employment or volunteering in the facility. Any investigated allegation of child abuse or neglect involving these persons in which the investigator finds reasonable cause to believe that the individual is the alleged perpetrator of child abuse or neglect shall be evaluated by the department. After review, the department may prohibit the person from being present in the facility during child care hours. The department may request a criminal record review from the Missouri State Highway Patrol for any adult present in the facility when child care children are present. The criminal record reviews shall include records of criminal convictions, pending criminal charges, and suspended imposition of sentence during the term of probation.
