The swimming/wading pool was accessible to children as evidenced by the barricade was not safe - the barricade was a hard locking cover on the hot tub that was not engaged/locked. The hot tub is located outside of the fenced playground. The fenced playground is direct access from the facility.

19 CSR 30-61.085 Physical Requirements of the Family Day Care Home 3 (B) 3 states: Swimming and wading pools shall be fenced to prevent access by children. For family day care homes initially licensed after the effective date of these rules, the fence shall be at least forty-two inches (42") high and shall have a locked gate. Above-the ground pools may use a forty-two inch (42") fence around the top of the pool with barricades of the steps to the pool deck.
