The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence was not in good condition in that the bottom of one section and the bottom of the gate between the infant playground and the preschool playground is creating an entrapment area and has sharp, protruding wire.
