The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence was not in good condition in that the double gate on the concrete pad will not lock or latch as it appears to be broken. They have placed a concrete block both in front and back of gate to prevent the gate from fully opening; however, this is not secure or heavy enough to prevent the gate from opening.

The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence had openings that were between 3.5 and 9 inches and allow entrapment - the openings measured approximately 8 inches where the fence meets the top rail. The fence is not secured to the rail and can be pushed forward or pulled back. In addition there is an approximate 2" gap where the fence stops and the rail begins. This is located on the right hand side of fence when you walk off the deck.

19 CSR 30-62.192 Health Care (4) (A) states: No child shall be permitted to enroll in or attend any day care facility caring for ten (10) or more children unless the child has been immunized adequately against vaccine preventable childhood illnesses specified by the department in accordance with recommendations of the Immunization Practices Advisory Committee (ACIP). The parent or guardian of the child shall provide satisfactory evidence of the required immunizations. Satisfactory evidence means a statement, certificate or record from a physician or other recognized health facility or personnel, stating that the required immunizations have been given to the child and verifying the type of vaccine and the month, day and year of administration.
