The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence was not in good condition in that some areas can be pushed out at the bottom creating entrapment areas, the gate at the basement stairs (in the infant playarea) opens even though it is locked creating a hazard where children could fall down the concrete steps, top rails are not connected in some areas, making the fence wobbly and also creating the possibility that the top rails will fall off and hit a child. .
