The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence had openings that were between 3.5 and 9 inches and allow entrapment - the openings measured 12 inches located between house and end of fence on southwest side of house. Also gate was secured by bungie cord which had the potential to have opening of approximately 12-24 inches.
