The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence had openings that were between 3.5 and 9 inches and allow entrapment - the openings measured approximately 9 inches by 6 inches as this opening is located on the right side of the gate in the outdoor Preschool area when facing the School Age building.

The play area shall be located so it is convenient and the children can gain access to it without hazard. For facilities initially licensed after the effective date of these rules or for the installation of new fences in existing facilities, the fence shall be at least forty-two inches (42") high. An outdoor play area used exclusively for school-age children shall not be required to have a fence. Fences shall be constructed to prevent children from crawling or falling through or becoming entrapped.

Criminal background check results were not on file for Carol Burns. Carol Burns worked from 7:00am until 11:30am on October 7, 2021. On October 14, 2021 the director Nena Koelling stated that the comprehensive background screening process was never conducted on Carol Burns prior to her presence in the child care center. Carol Burns stated on December 30, 2021 that her first and last day at the child care center was October 7, 2021. Nena Koelling stated on October 14, 2021 that Carol Burns has not worked at the child care center any additional days after October 7, 2021.
