For facilities initially licensed after the effective date of these rules or for the installation of new fences in existing facilities, the fence shall be at least forty-two inches (42") high. An outdoor play area used exclusively for school-age children shall not be required to have a fence. Fences shall be constructed to prevent children from crawling or falling through or becoming entrapped.

The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the outdoor space did not adjoin the child care property - the space was located adjoining the building, however the children had to travel outside the outdoor play area to get to the play area. The children exit the building through the main door to get to the outdoor play place, and they walk along the sidewalk that adjoins the parking lot, to their outdoor play place.

The training shall be certified by a nationally-recognized organization, such as the American Red Cross, American Heart Association, or an equivalent certification, include an in-person skills assessment, and be approved by the department.

The provider did not follow required procedures for accidents, injuries and emergency medical care as evidenced by parents were not notified immediately when a child cut his finger while CI Pleimann and CI Sims were present during the inspection. The facility completed an incident form, however was unaware that the parent needed to be contacted immediately. CI Pleimann and CI Sims discussed the incident and rule requirement with the director, Teri Stark. The parent was contacted via phone during the inspection.
