The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence was not in good condition in that loose chain link fence attached to perimeter pole and chain link fencing detached from the horizontal pole on the back side of the school-age walk-way, multiple wooden boards with exposed nails, as well as mounds of gravel making an uneven level.
