Requirements for supervision of napping children were not met as evidenced by infants and toddlers did not have constant care and supervision in that four infants all age 6-months-old were observed in a nap room that was completely enclosed by floor-to-ceilings walls with a full door. The door was oserved almost all the way closed and the lights were off in the nap room. The nap room consisted of cribs alone the walls. Not all infants were asleep and two infants were crying.

5 CSR 25-500.182 Child Care Program (1) (D) 1. states: Infants and toddlers shall have constant care and supervision. Home monitors or commercial devices marketed to reduce the risk of Sudden Infant Death Syndrome (SIDS) shall not be used in place of supervision while children are napping or sleeping.
