The premises were not safe and suitable as evidenced by the toilet seat and lid located in the first stall of the children's bathroom is not in good condition as evidenced by peeling and chipping material on the lid. The material exposed appears to be an absorbent non porous surface which cannot be easily cleaned.

The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence was not in good condition in that there are 3 spaces on the fence where the fence is no longer secured to the top rail causing gaps at the top of the fence. When pushed out the fence has gaps up to 6 inches.

An outdoor play area used exclusively for school-age children shall not be required to have a fence.
