5 CSR 25-500.162 Overlap Care of Children
Violation
| | Provider Comments |
Violation The requirements for written approval for overlap care were not met as evidenced by the hours of overlap exceeded two hours total in a 24 hour period - the hours were 10:50 AM to 11 AM. There were 54 children on premises before approved overlap hours . Overlap is 11 AM-12PM and 3:30-4:30 PM. During the return inspection on 8/14/25 the capacity of the children was 41, and around 9 AM Caregiver Abrielle Newheart took her nine children to the field trip at the park, reducing the capacity to 32 children total on premises. Licensing Rule Reference 5 CSR 25-500.162 Overlap Care of Children (1) states: There may be situations (for example, to accommodate parents' work shifts, before- and after-school care or before- and after- summer camp care) when the number of children in care may exceed the licensed capacity of the facility at the time of overlap. The number in care shall never be more than one-third (1/3) over the licensed capacity of the facility at the time of overlap. The overlap period(s) shall not exceed two (2) hours total in any twenty-four (24)-hour child-care day. The two (2) hours of available overlap time may be utilized in smaller time periods. Correction Required The facility shall not provide overlap care until written approval is received from the Office of Childhood and all requirements for overlap care are met.
