The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence was not in good condition in that the top bar on the chain-link fence was broken resulting in a portion of the metal bar hanging half way down on the side of the fence that was accessible to children. Children could run into the bar.

An outdoor play area used exclusively for school-age children shall not be required to have a fence. The facility did not have a fenced outdoor play area that was on or adjoining the day care property and was accessible without hazard as evidenced by the fence had openings that were between 3.5 and 9 inches and allow entrapment - the openings measured 4 inches by 8 inches at the bottom of the fence facing the dumpster and 4 inches along the metal fence. The fence was observed with a plastic moveable mesh material that was removed and loose in multiple sections. The mesh material was used to block off entrapment hazards in the fence.
