5 CSR 25-500.102(1)(E) Caregivers shall have knowledge of the needs of children and shall be sensitive to the capabilities, interests, and problems of children in care.
Conclusion Summary
Compliance Inspector (CI) Mariah Bloom and CI Heather Radney conducted an investigation of the allegation that Child A (4 years old) left his classroom and was unsupervised in the hallway and lobby. The allegation is substantiated based on the following information: 5 CSR 25-500.182(1)(A)3. which states "Caregivers shall provide frequent, direct contact so children are not left unobserved on the premises." On August 3, 2022, CI Mariah Bloom conducted a walkthrough of the facility to observe and document supervision and video documentation of the incident. CI Bloom reviewed and recorded camera footage with LLC Member/Director Kimberly Hutton who comments in the video that the time is an hour ahead. Video footage shows Child A (4 years old) is wearing an orange shirt. Child A leaves the classroom at 12:15:56 p.m. and enters the hallway. Child A runs through the hallway and exits the hallway into the lobby at 12:17:07 p.m. Administrative Assistant April Corbin exits the hallway into the lobby at 12:21:02 p.m. Child A is carried back through the lobby door by Administrative Assistant April Corbin at 12:21:12 p.m. Child A was unobserved on the premises for a period of over five minutes. 5 CSR 25-500.192(5)(A) which states "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions." On August 3, 2022, LLC Member/Director Kimberly Hutton reported that she notified Child A's family immediately once she returned to the facility at around 3:00 p.m. Caregiver Ashlyn Rachel reported she is unsure on the rule of notifying parents regarding incidents and that she had assumed April would call Child A's parents but she didn't call. Parents were not notified immediately of the incident. The incident occurred from 11:15 a.m.-11:21 a.m. and LLC Member/Director reported notifying Parent A (Child A's parent) around 3:00 p.m. 5 CSR 25-500.102(1)(E) which states "Caregivers shall have knowledge of the needs of children and shall be sensitive to the capabilities, interests, and problems of children in care." On August 3, 2022, LLC Member/Director Kimberly Hutton reported Child A (4 years old) is non verbal and has run out of the room a lot but typically is stopped by the teacher. Caregiver April Corbin reported Child A is not developmentally on target, is non verbal, is not potty-trained, does not like loud noises and gets overwhelmed. She also reported that Child A has tried to exit the room before but he hasn't gotten anywhere because the teacher usually catches him. Caregiver Ashlyn Rachel reported Child A is emotional; he can throw temper tantrums, will bite and pinch and likes to be secluded. She reported that Child A will try to go to the kitchen because it is quieter and he gets sensory over loaded. She reported if he is trying to run out, it is because he is overloaded and wants to get out but during this incident, he was very calm and did not appear to be over stimulated. Caregivers had knowledge of Child A and his previous behaviors and the need for increased supervision but Child A was still able to leave the classroom and remain unobserved on the premises for a period of over five minutes.

The facility shall notify all staff members of the violations which were substantiated, and specify the actions to be taken by all staff in order to comply with all licensing violations cited.
