Conclusion Summary
Compliance Inspector (CI) Jessica Glover conducted an investigation regarding the allegation that staff were restraining the children without proper training. After conducting the investigation, CI Glover finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.182(1)(C)3. which states: "Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions." On October 18, 2022, CI Glover interviewed Director Catrell and Manager Balleine who both stated that only Crisis Prevention Intervention (CPI) certified staff members implemented approved safety holds or restraints on the children when there was a crisis. Both stated that CPI methods were only conducted if a child was attempting to harm themselves or others and staff needed to intervene to prevent them from doing so. Director Catrell stated that staff would always use verbal communication with the child first but would then implement CPI methods as necessary. She stated that the CPI method included using safety holds on the child, which allowed certified staff to hold or restrain the child's arms back as a response to behaviors that posed a threat. Manager Balleine stated that CPI methods were not included in the facility's handbook and it was not documented each time in an accident/injury report. CI Glover reviewed the facility's Behavior Management policy in the parent handbook, which stated, "All participants are entitled to a pleasant and safe environment. We train our staff that discipline will be appropriate and constructive or educational in nature. We are committed to creating a complete safe, caring environment and an enjoyable recreational experience. Therefore, Camp Fire cannot serve participants who display unacceptable behavior. It is our intent that each student enjoys the activities planned. No physical discipline from staff is ever allowed. To do this, we inform the students of the basic rules of safety and good conduct and explain that each student is responsible for his/her own actions. Violation of this policy by a participant of the Afterschool Program will not be tolerated. Program staff will make every effort to communicate with parents when a disciplinary action needs to be taken. It is imperative that both students and parents understand the expectations of the Afterschool Program as well as the potential consequences. Please note that the first offense will result in a warning letter from the Afterschool Director. The second, third, and fourth offense will involve an administrator. These offenses will typically result in a suspension from the program. A total of four offenses an result in a permanent dismissal from the program. Administrators reserve the authority to exercise good judgment and issue a greater or lesser consequence as needed. Staff member will fill out an Incident/Accident Form and give a copy to the parents/guardians and discuss the student's behavior and what the next steps involve. These steps could include a parent or guardian/student/staff conference or Behavior Modification Contract or more. If the student breaks the contract or puts the safety of themselves or others is at risk, staff will let the Afterschool Director know, and they will decide what further action needs to be taken. Could result in suspending the student temporarily from the program or to remove them from the program entirely."
