Conclusion Summary
Compliance Inspector (CI) Jessica Glover conducted an investigation regarding the allegation that Child A (3-years-old) was able to repeatedly pull a chair over to the changing table to climb on and grab a bleach water spray bottle that he then used on other children. After conducting the investigation, CI Glover finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.102(1)(E) which states: "Caregivers shall have knowledge of the needs of children and shall be sensitive to the capabilities, interests, and problems of children in care." AND 5 CSR 25-500.082(1)(I) which states: " All flammable liquids, matches, cleaning supplies, poisonous materials, medicines, alcoholic beverages, hazardous personal care items or other hazardous items shall be inaccessible to children." On February 15, 2023, CI Glover interviewed Director Nicole Kincaid and Caregiver Tristan Jay whom both stated that even though Child A displayed challenging behaviors regularly, there was no individualized behavioral plan. Ms. Kincaid stated that she required for the parents to pick Child A up immediately from the facility on most days when his behaviors were too difficult to manage by Ms. Jay. Ms. Jay stated that Child A often times pushed a chair over to the changing table to reach for the bleach water spray bottle, and even when she attempted to move the spray bottles to a higher location, Child A continued to access them and spray towards her and the other children. CI Glover reviewed Child A's file but did not observe any individualized behavioral plan. CI Glover also did not observe any documentation regarding the challenging behaviors that both Ms. Kincaid and Ms. Jay stated Child A displayed. Parent A (Parent of Child A) stated that she was never aware of any behavioral plan for Child A but would instead have to pick him up early from the facility each time, even though the same behaviors continued to occur. Ms. Jay stated that she made sure to communicate with Child A after each incident to ensure he understood what was right versus wrong and provide individual attention when she could. However, there was no specific action taken to prove that caregivers were taking the time to have the knowledge of the needs of Child A and identify what the problems were to prevent incidents from happening in the future. CI Glover reviewed a behavioral incident report regarding Child A on January 25, 2023. CI Glover observed the document stating that Child A had climbed on the changing table many times, in which Ms. Jay then told him that it was not safe because he could hurt himself and informed him that his feet belonged on the ground. However, CI Glover did not find any evidence to support what the facility was doing to acknowledge the needs and problems that Child A was facing and determine how to prevent any future incidents.
