5 CSR 25-500.082(2)(B)2.B.(III) If a unit for infants and toddlers is auxiliary to a facility for older children, centers initially licensed for infant/toddler care after the effective date of these rules or facilities adding new infant/toddler space, shall have play, sleeping and bathroom space in the infant and toddler unit. This space shall be separated from the space used for older children by floor-to-ceiling walls;
5 CSR 25-500.222(6) Daily staff and volunteer attendance records shall be maintained and kept on file a minimum of one (1) year.
5 CSR 25-500.112(1)(A) Birth Through Two (2) Years. Groups composed of mixed ages through two (2) years shall have no less than one (1) adult to four (4) children, with no more than eight (8) children in a group;
Conclusion Summary
On February 22, 2023, the Office of Childhood received a report alleging the facility was out of ratio on 2/20/23. After conducting an investigation, Compliance Inspector (CI) Caylin Mertz has found this allegation to be substantiated based on the following evidence and rule violations: 5 CSR 25-500.222(6) which states "Daily staff and volunteer attendance records shall be maintained and kept on file a minimum of one (1) year." On February 24, 2023, Compliance Inspector (CI) Caylin Mertz conducted an unannounced inspection. Registered agent Neena Gill was interviewed. She reported she was present on 2/20/23 but does not clock in and out at the center or maintain a record of her attendance at the facility. 5 CSR 25-500.082(2)(B)2.B.(III) which states "If a unit for infants and toddlers is auxiliary to a facility for older children, centers initially licensed for infant/toddler care after the effective date of these rules or facilities adding new infant/toddler space, shall have play, sleeping and bathroom space in the infant and toddler unit. This space shall be separated from the space used for older children by floor-to-ceiling walls" On February 24, 2023, Compliance Inspector (CI) Caylin Mertz conducted an unannounced inspection. Attendance records were observed indicating at least five children under 2 years old were cared for in the preschool unit with up to six preschool age children on 2/20/23. AND 5 CSR 25-500.112(1)(A) which states "Birth Through Two (2) Years. Groups composed of mixed ages through two (2) years shall have no less than one (1) adult to four (4) children, with no more than eight (8) children in a group;" On February 24, 2023, CI Mertz conducted an unannounced inspection at the facility. Attendance records were observed indicating one caregiver was present from 5:21 p.m. until the facility closed at 6:00 p.m. with at least 10 children; two children under 1 year old, three children age 1 year old, one child age 2 years old, one child age 3 years old, and three children age 4 years old. Caregiver Cassie Gamache was interviewed and stated they did have ratio issues on 2/20/23. She believed she may have been caring for up to 12 children before she left for the day at 5:15 p.m. Registered agent Neena Gill was interviewed. She was present on 2/20/23; she was answering the door while Stephanie was caring for all of the children.
