Conclusion Summary
Compliance Inspector (CI) Jessica Ibbotson (Glover) conducted an investigation regarding the allegation that Caregiver Kirsten Hyland was not changing Child A's (3-years-old) diapers regularly. After conducting the investigation, CI Ibbotson (Glover) finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.182(1)(E)4. which states: "Diapers and wet clothing shall be changed promptly." On February 27, 2023, CI Ibbotson (Glover) interviewed Director Jessica Tran who stated that Caregiver Kirsten Hyland was given a verbal coaching in December 2022 due to her not changing diapers regularly. She stated that this occurred after Caregiver Jennifer Konja brought concerns to her about Ms. Hyland not changing her daughter's diapers and assisting in potty training each day. Even though staff were trained to document each diaper change and toileting for each day, she stated that Ms. Hyland was not completing it. Ms. Konja stated that her own daughter was in Ms. Hyland's classroom and was being picked up approximately twice per week with full diapers. She also stated that she did not believe Ms. Hyland was following through with potty training her daughter since the underwear she was bringing to school was always in her backpack. She expressed concerns to Ms. Hyland and Ms. Tran regarding the lack of diaper changes since she would pick her child up by 5:00 p.m., which was only thirty minutes after Ms. Hyland left for the day. Even though Ms. Hyland stated that she changed diapers every hour in her classroom, CI Ibbotson could not find any evidence to support this claim. When asked to review the Pro Care application on both days that Child A attended, Ms. Hyland stated that she was too busy to complete the daily logs. Ms. Hyland stated that was writing each diaper change on paper and would update the Pro Care application during naptime and at the end of her shift, but when asked to review her documentation on February 27, 2023, she stated that she did not have anything documented. CI Ibbotson interviewed Parent A (Parent of Child A) who stated that both days he attended the facility, his diaper was full each time and had started a diaper rash. Parent A also stated that Child A was in the same diaper that she dropped him off in that morning when she picked him up approximately nine to ten hours later. However, Ms. Hyland stated that it was not the same diaper because reporter/Parent A had brought multiple diapers and pull-ups to the facility, which were the same as what he was dropped off in. CI Ibbotson reviewed a "Team Member Discussion of Concerns' form created on December 28, 2022, regarding Ms. Hyland. CI Ibbotson observed the document stating, "concerns that children aren't being changed throughout the day while in Ms. Kirsten's care. Many have gone to other classes at the end of the day soaked from their pull-ups."
