RSMo 210.115.1. When any physician, medical examiner, coroner, dentist, chiropractor, optometrist, podiatrist, resident, intern, nurse, hospital or clinic personnel that are engaged in the examination, care, treatment or research of persons, and any other health practitioner, psychologist, mental health professional, social worker, day care center worker or other child-care worker, juvenile officer, probation or parole officer, jail or detention center personnel, teacher, principal or other school official, minister as provided by section 352.400, peace officer or law enforcement official, volunteer or personnel of a community service program that offers support services for families in crisis to assist in the delegation of any powers regarding the care and custody of a child by a properly executed power of attorney pursuant to sections 475.600 to 475.604, or other person with responsibility for the care of children has reasonable cause to suspect that a child has been or may be subjected to abuse or neglect or observes a child being subjected to conditions or circumstances which would reasonably result in abuse or neglect, that person shall immediately report to the division in accordance with the provisions of sections 210.109 to 210.183. No internal investigation shall be initiated until such a report has been made. As used in this section, the term "abuse" is not limited to abuse inflicted by a person responsible for the child's care, custody and control as specified in section 210.110, but shall also include abuse inflicted by any other person.
5 CSR 25-300.040 (1) Supervision and basic care shall be provided at all license-exempt facilities.
Conclusion Summary
Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation that two girls were in the same bathroom stall and were feeling each other's body parts (lower extremities- private parts). The allegation is substantiated based on the following information: 5 CSR 25-300.040 (1) which states "Supervision and basic care shall be provided at all license-exempt facilities." On March 16, 2023, Brooke McIntosh was in charge of the facility when Caregiver Emma Rudolph saw Child A and Child B in the same stall in the bathroom together and asked them to come out. On March 17, 2023, Brooke McIntosh was in charge of the facility when Emma Rudolph saw Child A and Child C in the bathroom alone washing their hands. Brooke took Child A to the office and Child A said she was touching Child C on her front and butthole and that Child C was touching her as well. On March 22, 2023, CI Radney interviewed Director, Rhonda Anderson, who stated that Child B made it sound to Emma like Child A wanted Child B to touch her butt while they were in the same bathroom stall after Child A climbed under the wall and into the stall with Child B. Emma talked to Child A and Child B but did not notify any other caregivers of the incident so that appropriate supervision for bathroom breaks could be enforced. On April 12, 2023, CI Radney interviewed Assistant Director, Karrie Brown, by phone, who stated that she was aware on Thursday, that two girls were in the bathroom alone and one of the girls asked the other one if they wanted to touch her privates and the girl said no. On March 23, 2023, Caregiver, Brooke McIntosh stated that she was concerned with child/abuse and neglect but did not report her concern to the Child Abuse/Neglect hotline. On March 24, 2023, Caregiver, Emma Rudolph, stated she was concerned with child abuse/neglect but she did not contact the child abuse/neglect hotline. On April 12, 2023, Assistant Director, Karrie Brown, stated she was concerned with child abuse/neglect but she did not contact the child abuse/neglect hotline. On April 13, 2023, Caregiver, Rachel Haenni, reported she was concerned with child abuse/neglect but she did not report her concern to the child abuse/neglect hotline.

The facility shall notify all staff members of the violations which were substantiated, and specify the actions to be taken by all staff in order to comply with all licensing violations cited.
