On April 21, 2023, the Office of Childhood (OOC) received an allegation that on 04/13/23, Child B, age 13 months old, was given Tylenol without Parent A's permission or having a medicine form filled out by Parent A. After conducting an investigation, Compliance Inspector (CI) Liz Hudson has found this allegation to be substantiated based on the following evidence:
5 CSR 25-500.192(3)(B)., which states: "All medication shall be given to a child only with the dated, written permission of the parent(s) stating the length of time medication may be given."
AND
5 CSR 25-500.192(2)(C)., which states: "Unusual behavior shall be monitored closely and parent(s) shall be contacted if the behavior continues or if other symptoms develop. These behaviors include, but shall not be limited to:"
AND
5 CSR 25-500.192(2)(C)3., which states: "Feels general discomfort or seems unwell;"
On May 2, 2023, CI Hudson conducted an unannounced inspection at Kids Village Learning Center LLC. CI Hudson interviewed Director Heidi Hawkins, Assistant Director Kourtney Hellmann as well as Teacher Cassidy Fedderson who admitted to administering Tylenol to Child B without current written consent of Parent A (Parent of Child B). Ms. Cassidy also stated that Child B was teething and being very fussy but that she did not contact Parent A about how Child B was feeling nor did she contact Parent A prior to, or following Child B receiving a dose of the Tylenol. Ms. Cassidy stated that she now knows that this was a mistake that she will not make again. She stated that she received training immediately after this incident was brought to management's attention. Ms. Heidi and Ms. Kourtney stated that immediate action was taken to address the incident and that staff have already participated in mandatory training reiterating program/state rules and regulations. Ms. Hawkins provided CI with the staff sign-off sheet as well as the content covered.
CI Hudson observed a copy of a BCC-11 Medication Authorization form which was signed by Parent A and dated February 2, 2023, for one day only. On this form, there were two entries for the administering of Tylenol; one for February 2, 2023 (5ml) and one for April 13, 2023 (5ml).
On May 4, 2023, CI Hudson conducted an interview via phone with Parent A (Parent of Child B) who stated that she had only given prior permission to give Child B Tylenol on February 02, 2023 for one day only and that no new current written permission had been given to give Child B Tylenol on April 13, 2023. She has taken the bottle of Tylenol from the facility so that this kind of mistake is not made again. She stated that Ms. Hawkins as well as Child B's teacher was very apologetic. Parent A stated that she was made aware that mandatory all staff training was held to reiterate instructions when dealing with illness/medications.
