Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that Child A had bruises and red scratch marks on his face when Parent A arrived to pick him up from the facility on April 25, 2023. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility:
5 CSR 25-500.192(5)(A) which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions."
On May 3, 2023, CI Ibbotson interviewed Owner Harris and Caregiver Curtis who both stated that Child A had ran into the wooden gate inside the 2-year-old classroom during naptime on April 25, 2023, at 3:00 p.m. Caregiver Curtis stated she was not present during the time of the accident but observed Child A's face when she returned from her work, observing red scratch marks on his left cheek bone area. Owner Harris stated that an accident/injury report was completed but Parent A was not notified of the accident until she arrived to pick Child A up from the facility at approximately 4:30 p.m. Both staff stated that it was uncommon for staff to not notify parents immediately after an accident or injury but that particular day and time was busy and staff were unable to call earlier. Owner Harris stated that the facility cameras were not functioning at that time due to a new installment that was scheduled for a later date.
CI Ibbotson interviewed Parent A who stated that she was not notified immediately after Child A had injured himself on April 25, 2023. Parent A stated she observed red scratch marks and bruises on the left side of his face when she arrived to pick him up at the facility. When asked what happened, Parent A stated she was informed that he was running around the classroom when he ran into the wooden gate. Parent A stated that Child A provided her with the same story.
CI Ibbotson reviewed an accident/injury report documented on April 25, 2023, regarding Child A. CI Ibbotson observed the report stating that at 3:00 p.m., "[Child A] got up from nap, starting running and wouldn't stop. Told multiple times to stop, ran into wall by the gate inside. (Trying to get out of room while other parents were entering daycare). He started crying when he ran into the wall, Kathy called for Raylene VanDorn, she looked at him, left cheek had a red mark, gave TLC, stopped crying. Kathy said will be ok to him-can't run indoors. Then went to snack and fine. Baylee returned at 3:30 he seemed fine." CI Ibbotson then observed that the document stated that the parent was notified verbally at approximately 4:30 p.m.
CI Ibbotson reviewed photo documentation of Child A's left cheek that was taken by Parent A the evening of April 25, 2023. Due to the coloring of the photo, CI Ibbotson could not identify the color of the injury but observed a mark approximately six inches long with a darker colored mark in the center that appeared to be approximately two inches long. CI Ibbotson also observed three smaller marks surrounding the area and scratch located above his ear, approximately one inch in length.
