Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that a staff member arrived to work under the influence of alcohol and narcotics. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility:
5 CSR 25-500.082(1)(K) which states: "No person shall smoke or otherwise use tobacco products in any area of the child care facility during the period of time when children cared for under the license are present."
On May 18, 2023, CI Ibbotson interviewed Manager Huffman and Assistant Director Simmons. Both staff stated that former Caregiver Walker arrived back to work from his break on December 30, 2022, under the influence of marijuana. Assistant Director Simmons stated that she smelt marijuana on former Caregiver Walker as he walked past her desk, in which she immediately reported it to Director Tran. She stated that former Caregiver Walker was in the classroom for approximately 10 to 15 minutes before she and Director Tran talked to him in the office. She stated that there were no abnormal behaviors, other than former Caregiver Walker moving very slow. She stated that none of the children seemed affected by this. She stated that former Caregiver Walker admitted to smoking marijuana in his car while on break on the premises of the facility. Manager Huffman and Assistant Director Simmons stated that former Caregiver Walker was terminated that same day.

The facility shall notify all staff members of the violations which were substantiated, and specify the actions to be taken by all staff in order to comply with all licensing violations cited. A copy of the memo, letter, or staff meeting agenda(s) shall be submitted to the Office of Childhood.
