Compliance Inspector (CI) Caylin Mertz and Compliance Inspector Supervisor (CIS) Romena Fox conducted an investigation of the allegation that there were 20 children to one adult. The allegation is substantiated based on the following information:
5 CSR 25-400.045 (18), which states: "The number and ages of children a family child care home is authorized to have in care at any one time shall be specified on the license and shall not be exceeded except as permitted within these rules."
AND
5 CSR 25-400.045 (19), which states: "All child care provided on the premises of a licensed family child care home shall be in compliance with the licensing rules, the conditions specified on the license, and the conditions of any variances granted to the licensee."
AND
5 CSR 25-400.105 (2)(A), which states: "A family child care home may be licensed for up to ten (10) children. The following staff/child ratios must be maintained at all times and shall not be exceeded except as permitted under these rules: 1 caregiver present, with up to 4 children, all may be under age two (2); 1 caregiver present, with 5-6 children, 3 children may be under age two (2); 1 caregiver present, with 7-10 children, 2 children may be under age two (2); 2 caregivers present, with up to 8 children, 8 children may be under age two (2); 2 caregivers present, with up to 10 children, 4 children may be under age two (2)."
On May 25, 2023, upon arrival, CI Mertz and Compliance Inspection Supervisor (CIS) Romena Fox observed 20 children, ages 2- to 5-years-old, cared for by one caregiver.
On May 25, 2023, caregiver Ebony Landis stated that she was alone with 17 children. [However, upon arrival, CI Mertz observed 20 children, ages 2- to 5-years-old.]
