On May 31, 2023, the Office of Childhood (OOC) received an allegation that the daycare workers slapped the children on the arm and neck and make them stand in the corner. After conducting an investigation, Compliance Inspector (CI) Patrick O'Malley has found the allegation to be substantiated based on the following evidence:
RSMo 210.254.2. which states: "The notice of parental responsibility shall include the following:"
AND
RSMo 210.254.2.(5) which states: "The disciplinary philosophy and policies of the child-care facility; and"
On June 1, 2023, CI O'Malley conducted an unannounced inspection of the facility and observed the Notice of Parental Responsibility form (NPR) dated December 2, 2022. The NPR notes, "Birth Academy ECE Center philosophy of discipline is to nurture the child's problem solving techniques, social skills and self confidence through positive reinforcement, encouragement and model behavior." The discipline policy noted on the NPR does not identify time out as a form of discipline to be used.
On June 1, 2023, director Miranda Bryant stated that time out is used for one minute per year of age with verbal redirection.
