5 CSR 25-600.020 (1) Prior to the employment or presence of a child care staff member in a licensed, regulated, or registered child care facility not exempted by section 210.1080.13, RSMo, the child care provider shall request the results of a criminal background check for such child care staff member from the department.
5 CSR 25-600.020 (5) Criminal background checks shall be completed for each child care staff member every five (5) years.
Conclusion Summary
On June 6, 2023, the Office of Childhood (OOC) received an allegation that staff, volunteers, and different males going in and out of Circle of Light Greater Achiever's Learning Center might pose a safety risk to children and might not have background screenings. After conducting an investigation, Compliance Inspector (CI) Patrick O'Malley has found this allegation to be substantiated based on the following evidence: 5 CSR 25-600.020 (1) which states: "Prior to the employment or presence of a child care staff member in a licensed, regulated, or registered child care facility not exempted by section 210.1080.13, RSMo, the child care provider shall request the results of a criminal background check for such child care staff member from the department." AND 5 CSR 25-600.020 (5) which states: "Criminal background checks shall be completed for each child care staff member every five (5) years." On June 8, 2023, director Renada Redmond stated that the facility had no eligibility letters for herself or any of her staff and volunteers. None of the employees or volunteers had received criminal background checks or eligibility letters and the facility does receive subsidy funds. On June 8, 2023, teacher Claudia Johnson stated that the facility had no eligibility letters for herself or any of her staff and volunteers. The facility shall ensure that all employees have a comprehensive background screening completed prior to a person's employment and/or presence within the child care facility. The comprehensive background screening must include verification of fingerprinting of the individual and a requested screening from the Family Care Safety Registry.
