|
Swimming and wading pools shall have a water filtration system. The water in swimming and wading pools shall be treated, cleaned and maintained in accordance with health practices and rules as determined by the local or state health authority, or both.

|
Swimming and wading pools shall be fenced to prevent access by children. For facilities initially licensed after the effective date of these rules, the fence shall be at least forty-two inches (42") high and shall have a locked gate. Above-the-ground pools may use a forty-two inch (42") fence around the top of the pool with barricades of the steps to the pool deck.

On June 20, 2023, the Office of Childhood (OOC) received an allegation that the facility has wading pools without a filtration system or a fence around them. After conducting an investigation, Compliance Inspector (CI) Michelle Honea found the allegation to be substantiated based on the following evidence:
5 CSR 25-500.087(7)(B) which states: "Swimming and wading pools shall have a water filtration system. The water in swimming and wading pools shall be treated, cleaned and maintained in accordance with health practices and rules as determined by the local or state health authority, or both."
AND
5 CSR 25-500.082(7)(C) which states: "Swimming and wading pools shall be fenced to prevent access by children. For facilities initially licensed after the effective date of these rules, the fence shall be at least forty-two inches (42") high and shall have a locked gate. Above-the-ground pools may use a forty-two inch (42") fence around the top of the pool with barricades of the steps to the pool deck."
On June 22, 2023, CI Honea and Compliance Inspection Supervisor (CIS) Marla Chrisco conducted an unannounced inspection at the facility and interviewed the Director Morgan Brown and Melissa Anderson. All staff members stated they were not aware kiddy pools were not allowed. All staff stated that they believed it was the larger pools that the facility could not have without being fenced not the small plastic kiddy pools or the small inflatable pools. All staff stated they were not aware that the smaller pools also needed a filtration system. All staff stated no pools will be allowed from now on and only water tables will be used.
On June 22, 2023, CI Honea observed a deflated pool laying on the ground next to the side of the facility.

The facility shall notify all staff members of the violations which were substantiated, and specify the actions to be taken by all staff in order to comply with all violations cited. A copy of the memo, letter, or staff meeting agenda shall be submitted to the Office of Childhood.
