Compliance Inspector (CI) Ian Fyfe conducted an investigation of the allegation that children in the 2-year-old room at the facility were playing with Orbeez. The allegation is substantiated based on the following information:
5 CSR 25-300.090 (7), which states: "Indoor play equipment and materials shall be provided and shall be clean and in good condition with all parts intact. Infants and toddlers shall have safe toys. Toys, parts of toys or other materials small enough to be swallowed shall not be used."
On June 30, 2023, CI Fyfe reviewed the Orbeez website and confirmed the recommended age range was 5+.
On July 11, 2023, director Erica Andress stated that on June 26, 2023, staff member Lexi Luebert brought Orbeez to the facility for the children to play with and children in the 2-year-old classroom were playing with them.
On July 14, 2023, staff member Aquila Kramer stated that she walked into the 2-year-old room and saw the Orbeez on the floor and the table.
On July 14, 2023, Jordan Dillan stated that she was conducting a routine sanitation inspection on June 26, 2023, and children in the 2-year-old room were playing with the Orbeez. One child had the Orbeez in their mouth.
