5 CSR 25-500.082(1)(I) All flammable liquids, matches, cleaning supplies, poisonous materials, medicines, alcoholic beverages, hazardous personal care items or other hazardous items shall be inaccessible to children.
5 CSR 25-500.082(2)(B)2.B. For all other group day care homes licensed for more than four (4) infant/toddlers and for all day care centers licensed for more than twenty (20) children or more than four (4) infant/toddlers, the following shall apply:
5 CSR 25-500.082(2)(B)2.B.(IV) No more than eight (8) infant/toddlers or sixteen (16) two (2) -year olds shall be in a group;
5 CSR 25-500.112(1) The following staff/child ratios shall be maintained on the premises at all times:
5 CSR 25-500.112(1)(A) Birth Through Two (2) Years. Groups composed of mixed ages through two (2) years shall have no less than one (1) adult to four (4) children, with no more than eight (8) children in a group;
5 CSR 25-500.112(1)(B) Age Two (2) Years. Groups composed solely of two (2) -year olds shall have no less than one (1) adult to eight (8) children, with no more than sixteen (16) children in a group;

Conclusion Summary
Compliance Inspector (CI) Caylin Mertz conducted an investigation of the allegations that there are too many children for available staff and a child touched a mouse trap. The gel of the mouse trap did get all over Child A's (20-months-old) hand. The allegation is substantiated based on the following information: 5 CSR 25-500.192(5)(A), which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions." On July 10, 2023, caregiver Mamefatim Ndiaya stated that about two weeks prior, she had put a mouse trap in the infant classroom under the back of the crib by the wall where she didn't think the children could reach. 5 CSR 25-500.192(5)(A), which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions." On July 10, 2023, caregiver Hannah Vanderberg stated that she was present when Child A touched a mouse trap. Child A had crawled under the crib. She heard Child A start to cry, and when she turned around, she saw Child A holding her binky with an attached stuffed animal and crying because it was sticky. She did not do an incident report and she was not sure if Child A's parents were told. On July 10, 2023, caregiver Cassie Whittlesey stated that she thought the incident occurred on June 19, 2023. She was getting snack ready and Hannah turned around to see Child A freaking out because her hands were sticky. They determined Child A had touched a sticky mouse trap that was under the crib. She didn't do an incident report and did not talk to Child A's parents about this. 5 CSR 25-500.082(2)(B)2.B., which states: "For all other group day care homes licensed for more than four (4) infant/toddlers and for all day care centers licensed for more than twenty (20) children or more than four (4) infant/toddlers, the following shall apply:" AND 5 CSR 25-500.082(2)(B)2.B.(IV), which states: "No more than eight (8) infant/toddlers or sixteen (16) two (2) -year olds shall be in a group;" AND 5 CSR 25-500.112(1), which states: "The following staff/child ratios shall be maintained on the premises at all times:" AND 5 CSR 25-500.112(1)(A), which states: "Birth Through Two (2) Years. Specifically: - 10 children, 12- to 18-months-old, were cared for by two caregivers - 19 children, all 2-years-old, were cared for by two caregivers - 11 children, 4- to 5-years-old, were cared for by one caregiver
