5 CSR 25-400.210 (9), which states: "All records of children shall be confidential, protected from unauthorized examination, and available to parents upon request."
On July 13, 2023, Parent A (parent of Child A) stated that Child A (4-years-old) had been enrolled at Renate's Childcare Academy since October 2021. In April 2023, she asked for a copy of Child A's attendance records. Renate Zahn refused to provide attendance records.
On July 13, 2023, Owner/Provider Renate Zahn stated that Parent B (parent of Child A) provided her a copy of the custody agreement. Parent A arrived at the facility on April 21, 2023, and demanded a copy of Child A's attendance records. She refused Parent A's request.
On July 13, 2023, CI O'Malley observed the custody agreement on file at the facility for Child A which showed a check mark next to "Joint Physical Custody Using Mother's Address." Nothing on the custody agreement or enrollment form indicated that Parent A was required to be excluded from parental rights.
5 CSR 25-400.210 (2), which states: "An individual file shall be kept to identify each child and to enable the provider to communicate with the parent(s), guardian, or legal custodian of the child in an emergency. Records shall include:"

5 CSR 25-400.210 (2) (B), which states: "Full name of the parent(s), guardian or legal custodian, home address, employers' name and address, work schedule, and home and work telephone numbers;"
AND
5 CSR 25-400.210 (2) (C), which states: "Name, address, and telephone number of another individual (friend or relative) who might be reached in an emergency when the parent(s), guardian, or legal custodian cannot be reached;"
On July 13, 2023, CI O'Malley observed the enrollment form on file at the facility for Child A which identified required enrollment information to be missing. Specifically:
- Parent A's work name, address, schedule, and phone number.
- Parent B's work phone number.
- An emergency contact address (not including Parent B).
