5 CSR 25-500.192(3)(B) All medication shall be given to a child only with the dated, written permission of the parent(s) stating the length of time medication may be given.
5 CSR 25-500.192(3)(I) The date and time(s) of administration, the name of the individual giving the medication and the quantity of any medication given shall be recorded promptly after administration. This information shall be filed in the child's record after the medication is no longer necessary.
5 CSR 25-500.222(4) Individual children's records shall be retained a minimum of one (1) year after the child discontinues attendance.
Conclusion Summary
Compliance Inspector Jessica Graham investigated the allegation that two weeks ago a staff member gave 4-year-old child a gummy at nap time, possibly with THC. This allegation is substantiated based on the following rule violation. 5 CSR 25-500.192(3)(B) which states: "All medication shall be given to a child only with the dated, written permission of the parent(s) stating the length of time medication may be given." AND 5 CSR 25-500.192(3)(I) which states: "The date and time(s) of administration, the name of the individual giving the medication and the quantity of any medication given shall be recorded promptly after administration. This information shall be filed in the child's record after the medication is no longer necessary." AND 5 CSR 25-500.222(4) which states: "Individual children's records shall be retained a minimum of one (1) year after the child discontinues attendance." On July 17, 2023, caregivers Sharma Brown, Sheila Noles, Tieteanna Roddy and Margaret Thatch all stated that there are a few children at the center that take melatonin gummies before nap time. These gummies are brought in by the parents and are requested that the children receive them each day to help them rest. A medication authorization form is filled out by each parent. All medication is kept in the locked office in a cabinet and is administered by Margaret Thatch. Child A, age 4-years-old, takes melatonin gummies each day at nap that her guardian provides to the center. No other type of medication has ever been offered to Child A or any other child at the facility. Margaret said that Parent A was mad at the center for various reasons and withdrew Child A. When she took Child A she took the melatonin and the medication form. One medication form was observed on file for a child that took melatonin while at the center. This form was not completed with the name of the medication, the time the medication should be administered or the length of time to give the medication. This child no longer attends the facility. The medication bottles were observed in a cabinet in the office. CI Graham attempted to contact Parent A and the aunt/emergency contact but no return calls were made and there was no voicemail box set up. Place of employment was contacted but Parent A no longer worked there.
