5 CSR 25-500.102(1)(A) Child care personnel shall be of good character and intent and shall be qualified to provide care conducive to the welfare of children.

5 CSR 25-500.222(4) Individual children's records shall be retained a minimum of one (1) year after the child discontinues attendance.
Conclusion Summary
Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that Child A had a bruise on the back of his head at pick-up, and the daycare had no explanation for it. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.192(5)(A) which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions." AND 5 CSR 25-500.192(5)(B) which states: "Information regarding the date and circumstance of any accident or injury shall be noted in the child's record." On July 17, 2023, CI Ibbotson interviewed Director Craigmile, Caregiver Terrell, Caregiver Wilson and Caregiver Alexander. All staff stated that parents were not informed after Child A had fallen and hit the back of his head on the concrete sidewalk on July 14, 2023. Caregiver Terrell, Caregiver Wilson and Caregiver Alexander stated that they did not complete an accident/injury report and did not communicate with neither parent regarding Child A's accident, even though marks were observed on the back of Child A's head immediately after the fall. CI Ibbotson reviewed Child A's file and did not observe an accident/injury report from July 14, 2023. CI Ibbotson was unable to review Child A's information in the Pro Care application due to the child no longer enrolled at the facility. 5 CSR 25-500.102(1)(A) which states: "Child care personnel shall be of good character and intent and shall be qualified to provide care conducive to the welfare of children." On July 17, 2023, CI Ibbotson interviewed Director Craigmile who stated that an accident/injury report was created on the same day that Child A had injured himself while playing outside on the playground. Director Craigmile stated she was unsure who completed the accident/injury report. CI Ibbotson reviewed Child A's file and did not observe an accident/injury report from July 14, 2023.
