5 CSR 25-600.020 (1) Prior to the employment or presence of a child care staff member in a licensed, regulated, or registered child care facility not exempted by section 210.1080.13, RSMo, the child care provider shall request the results of a criminal background check for such child care staff member from the department.
5 CSR 25-500.182(1)(A)1. Caregivers shall not leave any child without competent adult supervision.
5 CSR 25-500.102(1)(C) Individuals eighteen (18) years of age or older shall be counted in meeting the required staff/child ratios.
5 CSR 25-500.102(1)(K) The child care provider shall ensure that within seven (7) days of employment or volunteering, and before being left alone with children, that caregivers employed on or after August 30, 2019, receive a facility orientation. The facility orientation shall include:
5 CSR 25-500.102(1)(M) The provider shall request the results of a criminal background check for child care staff members as required by 5 CSR 25-600.020 General Requirements.
5 CSR 25-500.102(1)(N) Child care staff members shall have qualifying background screening results on file as required by 5 CSR 25-600.020 General Requirements.
5 CSR 25-500.082(6)(A)3. Adult supervision shall be provided at all times when children are outside. For children three (3) years of age and above, staff/child ratios may be one and one-half (1 1/2) times the indoor staff/child ratios. The required indoor staff/child ratios shall be maintained on the premises at all times.
5 CSR 25-500.222(2) An individual file shall be kept to identify each child and enable the provider to communicate with the parent(s) , guardian or legal custodian of the child in an emergency. Records shall include:
5 CSR 25-500.222(2)(A) The child's full name, address, birth-date and the date care begins and ends;
5 CSR 25-500.222(2)(B) Full name of the parent(s) , guardian or legal custodian, home address, employers' name and address, work schedule, and home and work telephone numbers;
5 CSR 25-500.222(2)(C) Name, address and telephone number of another individual (friend or relative) who might be reached in an emergency when the parent(s) , guardian or legal custodian cannot be reached;
5 CSR 25-500.222(2)(D) Name and phone number of the family physician, hospital, or both, to be used in an emergency;
5 CSR 25-500.222(2)(E) Name of the individual(s) authorized to take the child from the facility; and
5 CSR 25-500.222(3)(A) A medical examination report for each infant, toddler, or preschool child or a health report for each school-age child as required by 5 CSR 25-500.122 Medical Examination Reports;
Conclusion Summary
Compliance Inspector (CI) JD Greer conducted an investigation of the allegation that on July 14, 2023, Child A fell on a spring toy at the facility. The children were not properly supervised at the time. The allegation is substantiated based on the following information: 5 CSR 25-500.102(1)(C) which states, "Individuals eighteen (18) years of age or older shall be counted in meeting the required staff/child ratios." AND 5 CSR 25-500.182(1)(A)1. which states, "Caregivers shall not leave any child without competent adult supervision." AND 5 CSR 25-500.082(6)(A)3. which states, "Adult supervision shall be provided at all times when children are outside. For children three (3) years of age and above, staff/child ratios may be one and one-half (1 1/2) times the indoor staff/child ratios. The required indoor staff/child ratios shall be maintained on the premises at all times. " On July 19, 2023, CI Greer interviewed Managing Member (MM) Anny Roll who stated Caregivers A and Mckayla Knipp were present on the playground when Child A was injured. The injury occurred at approximately 8:50 a.m. The caregivers were present with 24 children at the time of the injury. Four children were 2 years old, and 20 children were 3 years old to 5 years old. Caregiver Knipp brought Child A into the building leaving Caregiver A with 23 children. Caregiver A is only 17 years old and does not count in ratio. On July 19, 2023, CI Greer reviewed video footage from the outdoor playground on July 14, 2023, and observed the time stamp on the video was approximately 8:46 a.m. Caregiver McKayla Knipp is standing in the middle of the playground in a dark blue short-sleeve shirt and patterned leggings. Caregiver A is sitting at the table next to the wooden railing and is mostly out of frame. The top of Caregiver A's head is visible. The two caregivers are present with 24 children. Child A is wearing a red short sleeved shirt and dark colored shorts. Child A appears to hit his face on the orange railing and falls to the floor of the toy car. Child A can be heard crying loudly. Caregiver Knipp responds immediately and Grabs Child A by the arm and briskly walks him into the building. At approximately 8:48 a.m., Caregiver A is outside alone with 23 children. At approximately 8:49 a.m. Caregiver Audrey Schroer steps outside. At Approximately 8:50 a.m. Caregiver Mckayla Knipp steps outside to assist in lining children up to come back inside. On July 19, 2023, CI Greer reviewed an incident report from the Brightwheel application for the injury to Child A and observed Child A and some friends were playing outside on the monster truck. Child A was bouncing with a friend on the truck. Child A fell forward and then backward. I (Caregiver Knipp) went over to check on him once I seen blood. There was me and one other teacher outside with 24 kids. The other teacher was on her phone the whole time. At the time of the incident, I was looking at the kids playing. 5 CSR 25-500.102(1)(K) which states, "The child care provider shall ensure that within seven (7) days of employment or volunteering, and before being left alone with children, that caregivers employed on or after August 30, 2019, receive a facility orientation. The facility orientation shall include:" On July 19, 2023, CI Greer interviewed MM Roll, who stated Caregiver A does not have any orientation completed and on file. 5 CSR 25-500.102(1)(M) which states, "The provider shall request the results of a criminal background check for child care staff members as required by 5 CSR 25-600.020 General Requirements." AND 5 CSR 25-500.102(1)(N) which states, "Child care staff members shall have qualifying background screening results on file as required by 5 CSR 25-600.020 General Requirements." AND 5 CSR 25-600.020 (1) which states, "Prior to the employment or presence of a child care staff member in a licensed, regulated, or registered child care facility not exempted by section 210.1080.13, RSMo, the child care provider shall request the results of a criminal background check for such child care staff member from the department." On July 19, 2023, CI Greer interviewed MM Roll, who stated Caregiver A does not have a background screening on file. 5 CSR 25-500.222(2) which states, "An individual file shall be kept to identify each child and enable the provider to communicate with the parent(s) , guardian or legal custodian of the child in an emergency.
