Compliance Inspector (CI) JD Greer conducted an unannounced investigation of the allegation that there were 16 children present at the family home. The allegation is substantiated based on the following information:
5 CSR 25-400.105 (2)(A) which states, "A family child care home may be licensed for up to ten (10) children. The following staff/child ratios must be maintained at all times and shall not be exceeded except as permitted under these rules: 1 caregiver present, with up to 4 children, all may be under age two (2); 1 caregiver present, with 5-6 children, 3 children may be under age two (2); 1 caregiver present, with 7-10 children, 2 children may be under age two (2); 2 caregivers present, with up to 8 children, 8 children may be under age two (2); 2 caregivers present, with up to 10 children, 4 children may be under age two (2)."
On July 19, 2023, Compliance Inspector (CI) JD Greer interviewed Owner Emily Hanke, who stated on July 18, 2023, there were 16 children present and she was not home. Owner Hanke left the 10 children in her care with her Assistant Shirley Latamonder. Owner Hanke's mother was watching Owner Hanke's 5 children when she needed assistance, which left Shirley Latamonder with 15 children in care. After Owner Hanke had left for the hospital, Owner Hanke's great aunt came over with her granddaughter to see if she could be of assistance. 16 children were present in the home with Assistant Shirley Latamonder and Owner Hanke's great aunt when sanitation arrived to do an inspection.
On July 19, 2023, CI Greer interviewed Assistant Shirley Latamonder, who stated she was present on July 18, 2023, with 16 children in the home.
