Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that Child A received an injury while at daycare by having his arm pulled, causing nursemaid's elbow. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of the licensing rule violation which occurred at the facility:
5 CSR 25-500.192(5)(A) which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions."
On July 31, 2023, CI Ibbotson interviewed Director Miller and Caregiver Hodge. Both staff stated that they did not notify Parent A immediately after Child A's accident. Director Miller stated she was unaware of the severity of pain Child A was in at the time, so she did not call Parent A. Caregiver Hodge stated that she did not notify Parent A immediately afterwards because children fell all of the time and she was unsure how serious the injury was. Director Miller stated that the accident occurred at approximately 11:45 a.m. but Parent A was not notified until she arrived to pick Child A up from the facility at approximately 1:45 p.m.
CI Ibbotson reviewed an accident/injury report regarding Child A from July 21, 2023. At 11:55 a.m., the report stated that Caregiver Hodge had her back facing Child A when he fell. Caregiver Hodge approached Child A as he was sitting in the corner crying. Caregiver Hodge asked Child A what was wrong, but he would not inform her of what happened. The report then stated that Caregiver Hodge held out her hand to help Child A stand up, in which he took. As Caregiver Hodge began to help him up, Child A became dead weight. Caregiver Hodge stated in the report that she got him up when Child A reported to Caregiver Hodge that his wrist hurt. Caregiver Hodge laid him down on his cot and he proceeded to fall asleep. The report then stated that Child A woke up once during naptime, stating that his wrist hurt because he had fallen. Caregiver Hodge placed an icepack on his wrist once Child A fell back asleep.
On July 31, 2023, CI Ibbotson interviewed Parent A who confirmed that she was not notified of the accident regarding Child A until she arrived to pick him up at approximately 1:45 p.m.
