Conclusion Summary
Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that Child A had bruising after attending the daycare and Parent A did not receive any documentation regarding the accident. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.192(5)(A) which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions." AND 5 CSR 25-500.192(5)(B) which states: "Information regarding the date and circumstance of any accident or injury shall be noted in the child's record." On August 16, 2023, CI Ibbotson interviewed Parent A, Caregiver Sheffield, Assistant Director Walker, Caregiver Clezki and Caregiver Bauman. Parent A stated that staff did not inform her of any bruising on Child A's stomach until the following day. Caregiver Clezki and Caregiver Bauman both stated that they observed the bruises but did not complete an accident/injury report or notify Parent A immediately. Caregiver Bauman stated she did not complete accident/injury reports unless she was aware of how the child got injured and because she was unsure of where the bruises on Child A's stomach came from, she did not complete one. Caregiver Bauman also stated she did not communicate with Parent A regarding the bruises until the following day but had observed the marks on Child A's abdominal area the day prior after coming in from playing outside. Caregiver Bauman stated she believed the bruise marks came from the jungle gym that Child A was playing on but was unsure. Caregiver Sheffield and Assistant Director Walker stated that staff were trained to complete accident/injury reports and to notify the parents immediately afterwards but confirmed that there was no documentation for Child A's bruises on his stomach. CI Ibbotson observed Child A and documented three round bruises on the left side of Child A 's abdominal area. All three bruises appeared to be brown and yellow in color, with one being approximately one inch, located above the other two smaller bruises. The second bruise was approximately half of one inch while the third bruise was approximately a quarter of one inch. CI Ibbotson reviewed video footage of Child A playing on the jungle gym outside. Child A was observed flipping over one of the bars, which was touching his abdominal area. Child A did not seem injured as he continued to flip over the bar repeatedly. CI Ibbotson attempted to interview Child A but was unsuccessful.
