5 CSR 25-500.042(19) All child care provided on the premises of a licensed group child care home or child care center shall be in compliance with the licensing rules, the conditions specified on the license, and the conditions of any variances granted to the licensee.
Conclusion Summary
Compliance Inspector Jessica Graham investigated the allegation that on August 17, 2023, 77 children present were present and the facility is only licensed for a capacity of 60. The facility is only licensed for 60 children. This allegation is substantiated based on the following rule violation. 5 CSR 25-500.042(18) which states: "The number and ages of children a group child care home or child care center is authorized to have in care at any one (1) time shall be specified on the license and shall not be exceeded except as permitted within these rules." AND 5 CSR 25-500.042(19) which states: "All child care provided on the premises of a licensed group child care home or child care center shall be in compliance with the licensing rules, the conditions specified on the license, and the conditions of any variances granted to the licensee." On August 24, 2023, director Margaret Thatch stated that she knows that she is only licensed for 60 children and had more than that at one time. She thought that her overlap would cover school age children during the summer for the entire day. She had been doing this for a long time but she has reduced to remain in her licensed capacity.
