5 CSR 25-500.182(1)(A)1. Caregivers shall not leave any child without competent adult supervision.
5 CSR 25-500.182(1)(A)5. A caregiver shall remain in the room with preschool and school-age children while they are napping or sleeping and shall be able to see and hear them if they have difficulty during napping or when they awaken.
5 CSR 25-500.102(1)(K) The child care provider shall ensure that within seven (7) days of employment or volunteering, and before being left alone with children, that caregivers employed on or after August 30, 2019, receive a facility orientation. The facility orientation shall include:
5 CSR 25-500.102(1)(L) The child care provider shall ensure that documentation of caregiver completion of the facility orientation is maintained and on file for review by the department.
5 CSR 25-500.082(1)(K) No person shall smoke or otherwise use tobacco products in any area of the child care facility during the period of time when children cared for under the license are present.
Conclusion Summary
On August 17, 2023 the Office of Childhood received a report alleging "Concerns for daycare staff and teachers smoking vapes in the classrooms and bathrooms. It is believed they are nicotine vapes. Staff have been seen vaping with the 2-year-old age group and school-aged group. No known incident or health effects on children at the daycare stemming from vapes. Concerns for teachers sleeping in the classrooms while children are still present. Unknown if any other adult present to supervise. Unknown which age group this occurred with. No known incident with children at the daycare stemming from potential supervision lapses." After conducting an investigation, Compliance Inspector (CI) Caylin Mertz has found these allegations to be substantiated based on the following evidence and rule violations: 5 CSR 25-500.182(1)(A)1 which states "Caregivers shall not leave any child without competent adult supervision." 5 CSR 25-500.182(1)(A)5 which states "A caregiver shall remain in the room with preschool and school-age children while they are napping or sleeping and shall be able to see and hear them if they have difficulty during napping or when they awaken." On August 25, 2023 Compliance Inspector (CI) Caylin Mertz conducted an unannounced inspection at the facility. CI Mertz conducted a walkthrough of the facility. LLC Member Hunter Johnston indicated Caregiver Kassidy was asleep in the 2 year old classroom during nap time. It is unknown how long Caregiver Kassidy was asleep. She was unable to provide supervision while sleeping. On October 17, 2023 CI Mertz interviewed Former Assistant Director Maddie Ogden and Caregiver Kassidy Beal. Maddie indicated Caregiver Kassidy had been asleep on the classroom floor during nap time. LLC Member Hunter immediately pulled Caregiver Kassidy into the office to discuss her behavior. Caregiver Kassidy indicates she did have her eyes on closed on the date of the incident but denies that she was asleep. While a caregiver was present in the room, she was unable to supervise the children if she was asleep or if her eyes were closed. 5 CSR 25-500.082(1)(K) which states "No person shall smoke or otherwise use tobacco products in any area of the child care facility during the period of time when children cared for under the license are present." LLC Member Hunter Johnston indicated Caregiver Mackenzie Miller was vaping in the staff bathroom at the facility. She was notified of this after Caregiver Mackenzie quit. Caregiver Taylor Dudley indicated she did not observe it but heard that a former caregiver was vaping in the bathroom. They are told not to bring vapes in. Former Caregiver Kassidy Beal was interviewed and indicated caregivers were vaping in the staff bathroom but she did not recall which caregivers. Former Assistant Director Maddie Ogden stated Caregiver Mackenzie was heard coughing in the staff bathroom when another caregiver stated she was vaping. She believed LLC Member Hunter already knew this was occurring. Caregiver Mackenzie quit on August 16, 2023. 5 CSR 25-500.102(1)(K) which states "The child care provider shall ensure that within seven (7) days of employment or volunteering, and before being left alone with children, that caregivers employed on or after August 30, 2019, receive a facility orientation. CI Mertz observed a caregiver file for Mackenzie Miller. CI Mertz did not observe a New Employee Orientation. LLC Member Hunter Johnston indicated it may not have been completed. Former Assistant Director Maddie Ogden indicated she did not receive any training.
