On August 21, 2023, the Office of Childhood (OOC) received an allegation that on August 21, 2023, at approximately 8:30 a.m., the pre-k classroom at Adventure Learning Center, Ltd., had one teacher with twenty-five children ages 3-years-old to 4-years-old. After conducting an investigation, Compliance Inspector (CI) Patrick O'Malley has found this allegation to be substantiated based on the following evidence:
5 CSR 25-500.112(1), which states: "The following staff/child ratios shall be maintained on the premises at all times:"
AND
5 CSR 25-500.112(1)(C), which states: "Ages Three Through Four (3-4) Years. Groups composed solely of three (3) - and four (4) -year olds shall have no less than one (1) adult to ten (10) children;"
On August 22, 2023, director Cindy Lyburger stated that the facility was out of ratio on August 21, 2023. The facility had difficulty maintaining ratios over the past month due to lack of staff.
On August 22, 2023, teacher Kassandra Hammurstendt stated that on August 21, 2023, there were twenty-five children. ages 3- to 5-years-old, with two teachers for the majority of the day.
