Conclusion Summary
Compliance Inspector Jessica Graham investigated the allegation that on Thursday August 17th, Child A (6 years old) and other children were left unsupervised. During this time a group of older children coerced Child A to expose himself. Staff were in another room with another child when this occurred. This allegation is substantiated based on the following rule violation: 5 CSR 25-500.102(1)(E) which states: "Caregivers shall have knowledge of the needs of children and shall be sensitive to the capabilities, interests, and problems of children in care." On August 17th, 2023, director Christina Paisley and she said she was told that Caitlyn Atchley, caregiver, had stepped into the bathroom to help a child and when she walked out Child A was pulling his pants up while in the classroom. She never reviewed any of the camera footage to see what happened and the footage did not record. Caregiver Caitlyn Atchley said that she was in the classroom with the school age children and had stepped into the bathroom in the classroom. She was in there two minutes or less. While in the bathroom, she heard a child say "pull your pants down" and then another child said it. One child said not to do it. Prior to this, there were issues going on with children watching inappropriate things on tablets and talking about racial comments and strip club comments. When she got out of the bathroom Child A was standing in the room with his pants down and his underwear partially down. She felt like he was provoked to do this. Caitlyn did not ask anyone to step in for her while she used the bathroom and was aware of incidents happening of this nature prior to using the restroom and leaving the room unsupervised. During the investigation, CI Graham observed an incident report for Child A dated 8/17/2023. The time of incident was 9:30am and Parent A was notified at 10:29am via text message. The incident report stated "Child A was prompted by several other students to pull his pants down and he did. The teacher caught him and he immediately pulled them back up." The action taken stated "I talked to Child A about what is appropriate and not appropriate at school and parents were contacted. Students tat prompted the incident were sent home." CI Graham observed text messages between Caitlyn Atchely, caregiver using Rachael Neirmann's phone) to Parent B (Parent of Child A) The message stated "Hey this is Rachael form little miracles just letting you know a child told Child A to pull his pants down and he did it in front of the whole class we talked to him and told him we do not show private parts and what is appropriate and not appropriate just wanted to let you know" Parent B replied "okay, that's not like Child A at all. If possible remove him for that class around that child/children. Child A is 6 years old he's very conservative and doesn't even like it when we have to help him dry off or get dressed. we will need an accident report and i would like for something to be done about it with that other child or i will be calling state. there's no reason why ANY child should be saying that and i know that this has been a problem for years. Caitlyn replied "The children where sent home and there will be an accident report" Parent A (Parent of Child A) replied "Yeah I agree with Parent B he doesnt neednto be around the kids that are gonna be doing that type of stuff" Child A is no longer attending and was not able to be interviewed. On September 5, 2023, CI Graham called Parent B but no contact was made. A returned called was never received.
