5 CSR 25-500.102(2)(A)1.A. A Center Director/Group Child Care Home Provider Certification Request form shall be submitted to the department. Once the center director or group child care home provider is certificated by the department, the Center Director/Group Child Care Home Provider Approval Request form shall be submitted to the department and maintained on file at the facility. See Center Director/Group Child Care Home Provider Approval Request form, revised 2021 and incorporated by reference in this rule. Conclusion Summary
Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that there was no approved director. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.102(2)(A)1. which states: "An approved certificated group child care home provider or center director shall be responsible for planning, monitoring, and managing the facility's daily program." AND 5 CSR 25-500.102(2)(A)1.A. which states: "A Center Director/Group Child Care Home Provider Certification Request form shall be submitted to the department. See Center Director/Group Child Care Home Provider Certification Request form, revised 2022 and incorporated by reference in this rule as published by the Missouri Department of Elementary and Secondary Education, PO Box 480, Jefferson City, MO 65102-0480 and available by the department at https://dese.mo.gov/childhood/forms. On August 29, 2023, CI Ibbotson interviewed Manager Sollars who stated that she started as the director at the beginning of the school year in August 2023. She stated that she completed the necessary paperwork and submitted it to Board President Ingersoll but had not received any information since regarding the status of her approval. On October 16, 2023, CI Ibbotson contacted the facility's assigned CI, Katie Bruggeman, who stated that Manager Sollars has an approved director certification as of September 11, 2023, but she had not received any documentation from the facility in order to approve her as the director. On October 17, 2023, CI Ibbotson reviewed documentation provided by Board President Ingersoll. CI Ibbotson observed that the Center Director/Group Child Care home Provider Certification Request was not submitted to the Office of Childhood (OOC) until August 31, 2023.
