5 CSR 25-500.082(2)(A)6. Walls, ceilings and floors shall be finished with material which can be cleaned easily and shall be free of splinters, cracks and chipping paint. Floor covering shall be in good condition. Lead-free paint shall be used for all painted surfaces.
5 CSR 25-500.192(5)(A) In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions.
5 CSR 25-500.192(5)(B) Information regarding the date and circumstance of any accident or injury shall be noted in the child's record.
5 CSR 25-500.112(1) The following staff/child ratios shall be maintained on the premises at all times:
5 CSR 25-500.112(1)(A) Birth Through Two (2) Years. Groups composed of mixed ages through two (2) years shall have no less than one (1) adult to four (4) children, with no more than eight (8) children in a group;
5 CSR 25-500.112(1)(E) Mixed Age Groups Two Years (2) and Up. Groups composed of mixed ages of children two (2) years of age and older shall have no less than one (1) adult to ten (10) children with a maximum of four (4) two (2) -year olds. When there are more than four (4) two (2) -year olds in a mixed group, the staff/child ratio shall be no less than one (1) adult to eight (8) children.
Conclusion Summary
On August 31, 2023, the Office of Childhood (OOC) received the allegation that there is an unfinished hardwood floor that children who are crawling on are regularly having splinters. After conducting an investigation, Compliance Inspector (CI) Michelle Honea found the allegation to be substantiated based on the following information: 5 CSR 25-500.082(2)(A)6., which states: "Walls, ceilings and floors shall be finished with material which can be cleaned easily and shall be free of splinters, cracks and chipping paint. Floor covering shall be in good condition. Lead-free paint shall be used for all painted surfaces." On September 12, 2023, CI Honea conducted a walkthrough of the facility and observed the floors in all areas that the children play to be in need of repair. The floors are worn and rough with sharp edges which could cause splinters to children walking and crawling across the floor. On September 12, 2023, director Chanda Winn stated that the floors have been an ongoing problem. She has talked to the owners about the floors, but they are not willing to fix the floors. The children are getting splinters in their hands and feet from the floors. Caregiver Cheyenne Winn stated that the parents are constantly complaining about how bad the floors are. Children are continually getting splinters from the floors.
