5 CSR 25-500.112(1) The following staff/child ratios shall be maintained on the premises at all times:
5 CSR 25-500.112(1)(E) Mixed Age Groups Two Years (2) and Up. Groups composed of mixed ages of children two (2) years of age and older shall have no less than one (1) adult to ten (10) children with a maximum of four (4) two (2) -year olds. When there are more than four (4) two (2) -year olds in a mixed group, the staff/child ratio shall be no less than one (1) adult to eight (8) children.
5 CSR 25-500.182(1)(A)1. Caregivers shall not leave any child without competent adult supervision.
5 CSR 25-500.182(1)(A)3. Caregivers shall provide frequent, direct contact so children are not left unobserved on the premises.
5 CSR 25-500.182(1)(D)1. Infants and toddlers shall have constant care and supervision. Home monitors or commercial devices marketed to reduce the risk of Sudden Infant Death Syndrome (SIDS) shall not be used in place of supervision while children are napping or sleeping.
Conclusion Summary
Compliance Inspector (CI) Jessica Graham investigated the allegation that on September 8, 2023, one teacher had 18 preschoolers and school-agers by themselves all day. This allegation is substantiated based on the following information. 5 CSR 25-500.112(1) which states: "The following staff/child ratios shall be maintained on the premises at all times:" AND 5 CSR 25-500.112(1)(E) which states: "Mixed Age Groups Two Years (2) and Up. Groups composed of mixed ages of children two (2) years of age and older shall have no less than one (1) adult to ten (10) children with a maximum of four (4) two (2) -year olds. When there are more than four (4) two (2) -year olds in a mixed group, the staff/child ratio shall be no less than one (1) adult to eight (8) children." On September 13, 2023, caregiver Autumn Johnson stated that they are short-staffed and a teacher was left in the room one morning with 18 children by herself. The teacher asked for help but it took more than an hour for someone to get to her. On September 18, 2023, caregiver Alyssa AuBuchon stated that she is typically over ratio with mixed groups of children, ages 2-, 3-, and 4-years-old. A staff will eventually come in the room but they are usually late and that causes her to go over ratio. She had told Mindy about the ratio issues a few times. Mindy would eventually get someone to come in the room but it would take an hour or so.
