5 CSR 25-500.202(2)(B) The written diet plan for each infant/toddler shall be followed. The parent(s) shall update the plan according to the individual needs of the child until they grant permission in writing for the child to eat table foods.
Conclusion Summary
Compliance Inspector (CI) Cole Eddins and Compliance Inspector Supervisor (CIS) Romena Fox completed an unannounced inspection regarding the allegation that Child A was given the wrong bottle of breastmilk by accident by a new staff member one time. After conducting the investigation, CI Eddins and CIS Fox finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-500.202 Nutrition and Food Service(2)(A). Which states: "The provider shall serve nourishing foods appropriate for the infant's nutritional requirements and developmental stages as specified by his/her parent(s) in a written diet plan." AND 5 CSR 25-500.202 Nutrition and Food Service(2)(B). Which states, "The written diet plan for each infant/toddler shall be followed. The parent(s) shall update the plan according to the individual needs of the child until they grant permission in writing for the child to eat table foods." On September 18, 2023, Compliance Inspector (CI) Cole Eddins and Compliance Inspector Supervisor (CIS) Romena Fox conducted a walkthrough of the facility and observed the room that Child A was given the wrong breastmilk in. CI Eddins observed Child A's Infant and toddler feeding and care plan which was signed and dated by Parent A (parent of Child A) on August 06, 2023. The plan stated that five ounces of breast milk is supposed to be given to Child A three times a day. On September 18, 2023, CI Eddins and CIS Fox interviewed Caregiver Hallie Schley, Caregiver Aliyah Hendrix and Director Cara Haag. Caregiver Hallie Schley stated that she gave Child A the wrong breastmilk by mistake. She stated she was a floater, and the incident occurred on her second day working at the facility. Caregiver Aliyah Hendrix confirmed the information given by Caregiver Hallie Schley and stated that she had given Caregiver Hallie Schley instructions on what to feed Child A while she was gone on break. Caregiver Aliyah Hendrix stated that Caregiver Hallie Schley gave Child A the wrong bottle by accident. On September 18, 2023, CI Eddins and CIS Fox Interviewed Director Cara Haag who stated that Caregiver Hallie Schley is new and wasn't very familiar with the bottle labeling system. She said that Caregiver Aliyah Hendrix showed Caregiver Hallie which bottle to feed Child A before leaving on break. She later received a text from Caregiver Aliyah Hendrix stating that Caregiver Hallie Schley had given Child A the wrong bottle. On September 29, 2023, Compliance Inspector (CI) Cole Eddins and Compliance Inspector Supervisor (CIS) Romena Fox interviewed Parent A over the phone. Parent A stated that she first observed that something was wrong when she could not find one of Child A's bottles in Child A's cubby during pick-up time. She was eventually told that Child A's bottle was mixed up with another child's breastmilk bottle by accident and that Child A was fed the wrong bottle. She was informed by Director Cara that the main caregiver, Aliyah, had gone on break and the other caregiver, Hallie, had grabbed the wrong bottle by accident.
