Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation that The Vice-President of the facility, Dr. Carmen Valle Gomez, was present at the facility in October 2022, and Dr. Gomez was convicted of aggravated assault in Texas. It is unknown whether Dr. Gomez has an eligibility letter. The allegation is substantiated based on the following information:
5 CSR 25-600.020 (1) which states "Prior to the employment or presence of a child care staff member in a licensed, regulated, or registered child care facility not exempted by section 210.1080.13, RSMo, the child care provider shall request the results of a criminal background check for such child care staff member from the department."
On September 15, 2023, CI Radney conducted an unannounced inspection and interviewed Director Rosalina Marquez. She reported that Dr. Valle works in Texas and is the Vice President of UMOS, Inc. The only time she is aware of that Dr. Valle was present in the facility was last October 2022, when Dr. Valle toured with the Regional Director Rachel Overbey. She does not have an eligibility letter on file at the facility for Dr. Valle.
On September 29, 2023, CI Radney conducted a telephone interview with Regional Director Rachel Overbey. She reported that Dr. Valle is the Vice President of UMOS, Inc. and works in Texas. Dr. Valle was present at the facility last year, in September or October of 2022. She was present with Dr. Valle during the tour of the facility. CI Radney conducted a telephone interview with Director of Human Resources Victor Yado. He reported that Dr. Valle is the Vice President of UMOS, Inc. and he was not aware of her presence in the facility in Missouri, as she is based out of Texas. They do have a background check for Dr. Valle that was completed in Texas. On September 29, 2023, CI Radney conducted a telephone interview with Administrative Assistant of Human Resources Michelle Sosa who reported that she will send the criminal background check for Dr. Valle.
On October 27, 2023, CI Radney conducted a telephone interview with Maria Carmen Valle. She reported she is the Vice President of UMOS, Inc. and she has been employed since 2021. She visited the facility once, in October 2022. She does not have a key to the facility but she does have access to the facility to go in and monitor. That is not her primary function, however, so she has only been to the facility once. She does not know if she has an eligibility letter in Missouri but she does in Texas. She does not have any disqualifying offenses. When she visits facilities, she does not do that alone, it is with the center manager or another administrator.
On October 27, 2023, CI Radney received and reviewed the eligibility letter from Director of Human Resources Victor Yado. The following was observed: On October 27, 2023, CI Radney received and reviewed the Texas Health and Human Services report from Director of Human Services Victor Yado. The report is dated 3/3/21. The report letter reads "Your operation requested a background check for Maria C Valle, born in 1966. The following are alternate names for this person were also checked : Maria Carmen Gomez, Maria Carmen Valle. The results of the check are based on the identification information that your operation submitted for this individual. It is your responsibility to ensure the accuracy of the identifying data by reviewing supporting documents. Based on a review of the background check results, the Centralized Background Check Unit (CBCU) determined that this person is eligible to be present at your operation in the role of staff/employee. All background check types required for this role have been completed, and no further action is required at this time. The CBCU will notify you if this person's background check determination changes. The CBCU has conducted this background check in compliance with, and as required by Child Care Licensing minimum standards, rules, and other Texas and federal law. Notice: If you decide not to hire this person, or if the person is no longer employed by, living at, or otherwise associated with your operation, you must inactivate this person on the Background Check History webpage of your online provider account. If you do not have an online provider account or are unable to access it, notify your CBCU representative of the change in status. If this person continues to be associated with your operation, you must submit a renewal background check for this person on or before 2/4/26."
