On October 20, 2023, Compliance Inspector (CI) Cole Eddins and Compliance Inspector Supervisor (CIS) Romena Fox completed an unannounced inspection regarding the allegation that Parent A was not contacted immediately after her child, Child A, had been kicked in the head by Child B. After conducting the investigation, CI Eddins and CIS Fox finds the allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility:
5 CSR 25-500.192 Health Care (5)(A)
Accidents, Injuries and Emergency Medical Care. (A) In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s) written instructions.
On October 19, 2023, CI Eddins and CIS Fox conducted a walkthrough of the facility and observed the classroom that Child A was attending. CI Eddins and CIS Fox interviewed Caregiver Hill, Caregiver Scott, Caregiver Robinson and Caregiver Davis. All Caregivers stated that they have all heard from Parent A that she took her child (Child A) to see the doctor after Child A was complaining about her head hurting following the incident where Child B hit Child A's head on the playground. All caregivers have not observed any bruising or cuts on Child A's lip or body. Caregiver Hill and Caregiver Scott observed Child B going down the slide and hitting Child A on the head at the bottom of the slide. Both Caregiver Hill and Caregiver Robinson stated that they did not call Parent A to inform her that Child A was hit on the head.
On October 19th, 2023, CI Eddins and CIS Fox interviewed Supervisor Raina Davis, Director Matrika Hornsky and Child B (5-years-old). When interviewing Child B, she stated that she accidently kicked child A on the playground while going down the slide. Supervisor Davis stated that Parent A was notified of the incident that very same day, but Parent A was not contacted soon after the accident occurred. Director Horsky stated that Parent A was not notified through phone or email of Child A getting hit by Child B on that same day, but that Parent A was notified at the end of the day with the incident report. She has not observed many issues with Child A and Child B prior to the allegation. She stated that she heard about Parent A taking Child A to see the doctor. She stated that Parent A told her that the doctor told her to keep a close eye on her headaches moving forward.
On October 19th, 2023, Compliance Inspector (CI) Cole Eddins and Compliance Inspector Supervisor (CIS) Romena Fox observed the incident report dated October 12, 2023, stating that Child A was bumped by another child on the slide. The report was not signed and there was no information indicating that was not notified.
On October 31, 2023, CI Eddins interviewed Parent A over the phone. Parent A stated that Child B hit Child A on the head while both kids were outside on the playground. She observed an incident report, but she did not believe the report was accurate. She stated that United Inner-City Services did not notify her about Child A getting hit on the head by Child B and that she only found out about the incident at the end of the day. She also stated that she took Child A to the doctor due to Child A's head hurting and that she does not want Child A going back to daycare. Parent A did not want Child A to be interviewed by CI Eddins.
