5 CSR 25-300.050 (11) In case of an accident or injury to a child, the provider shall notify a parent immediately. If a child requires emergency medical care, a parent's prior written instructions shall be followed. A form shall be completed indicating the circumstances and the date and time of the injury. The form shall be signed by the caregiver and his/her supervisor. A copy of the form shall be given to the parent the day of the accident or injury and necessary explanations shall be given. The form shall be filed in the child's record.
5 CSR 25-300.080 (9)(D) All food shall be in sound condition;

5 CSR 25-300.090 (2)(F)2. A facility with a capacity of more than twenty (20) children or more than four (4) infants and toddlers shall have infant and toddler space separate from the older children. The space shall be separated by floor-to-ceiling walls with separate play, sleeping and bathroom space;
Conclusion Summary
Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that Child A had unexplained bruising around his eyes that staff attributed to him falling and his glasses causing the bruises. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility: 5 CSR 25-300.050 (11) which states: "In case of an accident or injury to a child, the provider shall notify a parent immediately. If a child requires emergency medical care, a parent's prior written instructions shall be followed. A form shall be completed indicating the circumstances and the date and time of the injury. The form shall be signed by the caregiver and his/her supervisor. A copy of the form shall be given to the parent the day of the accident or injury and necessary explanations shall be given. The form shall be filed in the child's record." On October 19, 2023, CI Ibbotson interviewed Director Clements and Caregiver Vanosdoll. Both staff stated that Child A had fallen on his face on the gym floor and broke his glasses, which is why they believed bruising occurred around his eye. Director Clements stated that she instructed for Caregiver Billups to complete an accident/injury report but was unsure why there was not one located in Child A's file. Caregiver Vanosdoll stated that she observed Child A after he fell and immediately saw a red line underneath his eye but could not recall which one. She stated that she informed Caregiver Billups to complete an accident/injury report as well but was unsure if she did. She stated that Child A informed her that he tripped while he was running with a friend but was unsure what he tripped on. She stated that the accident occurred at approximately 5:00 p.m. and the facility closed at 5:30 p.m. so she and Caregiver Billups waited until Parent A arrived to inform her of the accident. Both staff stated they were unaware of any bruising around Child B's eyes or face area. CI Ibbotson interviewed Child A who stated that he was running when he fell and broke his glasses. He stated that Child B never got hurt while at the daycare. CI Ibbotson reviewed Child A's file but did not observe any accident/injury reports. CI Ibbotson reviewed Child B's file and only observed one accident/injury report but it was not in relation to any bruises to the face or eye area. CI Ibbotson observed Child B but there were no notable marks or bruising.
