Compliance Inspector (CI) Jessica Ibbotson conducted an investigation regarding the allegation that Child A was found alone and unattended outside on the playground on October 24, 2023. After conducting the investigation, CI Ibbotson finds this allegation is substantiated. This conclusion is based on the following evidence of licensing rule violations which occurred at the facility:
5 CSR 25-500.182(1)(A)1. which states: "Caregivers shall not leave any child without competent adult supervision."
On October 26, 2023, CI Ibbotson interviewed Director Luke, Caregiver Sharp, Caregiver Walker and Caregiver Bourne. Director Luke stated she was not present on October 24, 2023, but was informed the following day by Caregiver Sharp that Child A was left outside alone and unattended by an exterminator who brought him to the door.
Caregiver Sharp stated that Caregiver Bourne and Caregiver Walker were responsible for Child A while they played outside on October 24, 2023. She stated that she informed both caregivers to bring the class inside for lunch and was informed approximately four to minutes later by Caregiver Bourne that Child A was found alone outside by an exterminator. Caregiver Bourne stated that she was informed by Caregiver Sharp at 11:13 a.m. to bring the class inside for lunch. She stated that at approximately 11:!6 a.m., an exterminator was at the door with Child A. She stated that she stood at the back of the line while the class was lined up outside while Caregiver Walker was in the front of line counting the children as they walked inside. She stated that she heard Caregiver Walker count to 10, which was the correct number of children that day so she went inside without conducting a walkthrough of the playground first. Caregiver Walker stated that an exterminator approached the door with Child A approximately five to seven minutes after coming in from outside, stating that he found Child A alone on the playground.
5 CSR 25-500.192(5)(A) which states: "In case of accident or injury to a child, the provider shall notify the parent(s) immediately. If the child requires emergency medical care, the provider shall follow the parent's(s') written instructions."
AND
5 CSR 25-500.192(5)(B) which states: "Information regarding the date and circumstance of any accident or injury shall be noted in the child's record."
On October 26, 2023, CI Ibbotson interviewed Director Luke, Caregiver Sharp, Caregiver Walker and Caregiver Bourne. Director Luke stated that an accident/injury report should have been created on October 24, 2023, regarding Child A being left outside unattended on the playground but there was not one in his file. She stated that Parent A should have been notified immediately afterwards but was unsure if she was. She stated that she would call Parent A that same day to inform her of the accident. Caregiver Bourne stated that an accident/injury report was not created and Parent A was not notified. Caregiver Sharp and Caregiver Walker both stated that they were unsure if an accident/injury report was created or if Parent A was notified. Caregiver Sharp, Caregiver Walker and Caregiver Bourne all stated that parents were not notified of any accident/injury until the parents picked up their child at the end of the day, regardless of what time the accident occurred.
CI Ibbotson reviewed Child A's file and did not observe any documentation regarding the accident on October 24, 2023.
On November 30, 2023, CI Ibbotson interviewed Parent A who stated that she was not informed of the accident until approximately two to three days afterwards. She stated that staff told her they were too scared to inform her because they thought she would be upset about it. She stated that she was typically notified of any accident/injury when she picked Child A up later that same day and had only received a phone call once immediately afterwards.
