Conclusion Summary
Compliance Inspector Jessica Graham investigated the allegation that on 10/30/23, for the first 2 minutes, an assistant teacher was in the room while a child was in the bathroom, but did not know he was in there. The last four minutes, they did not know where the child was. The whole incident was six minutes long. This allegation is substantiated based on the following rule violation. 5 CSR 25-500.182(1)(A)1., which states: "Caregivers shall not leave any child without competent adult supervision." AND 5 CSR 25-500.182(1)(A)3., which states: "Caregivers shall provide frequent, direct contact so children are not left unobserved on the premises." On November 2, 2023, caregivers Brenda Beard and Jackie Bullard stated they were the caregivers in charge of Child A, age 4-years-old, on October 30, 2023. The class was going outside for playtime and Jackie had taken a group of seven children outside while Brenda remained inside with four children. Child A was inside with Brenda. She was getting her group together to get their coats on for going outside. She saw Child A run beside her and assumed he was getting his coat on. During the time that Brenda was helping with coats, Jackie came inside to switch her spots. Child A was in the bathroom at the time but no one was aware. Brenda went outside with her children and Jackie stayed inside with the child she had brought in. After being outside for a while, a parent went into the classroom to sign out his child and that is when Child A walked outside. He went up to Jackie and told her that he went to the bathroom and when he came out no one was there. No one was aware that Child A was in the room until he came running outside. On November 2, 2023, CI Graham observed video footage with Brittany Schilling, family advocate. The video footage was approximately 7 minutes long. Caregivers in the room are Jackie Bullard and Brenda Beard. Child A is in a yellow shirt. -Three children are visible in the video, including Child A in the yellow shirt. -Brenda is helping children put their coats on. -Child A runs under the loft in the room. -Another child comes out from the loft, making the count in the room four children. -Child A is running around the room and goes into the bathroom that is in the classroom. -Brenda is helping the children put their coats on and does not see Child A run into the bathroom. -Child A enters the bathroom, turns on the light and shuts the door. -Brenda lines up two children and takes them outside as Jackie enters the room with one child. -Another child is in the room putting on his coat as Jackie enters. -Jackie gets her coat on and takes the two children outside; unaware that Child A is in the bathroom. -Child A remains in the bathroom while everyone else is outside for about two minutes. -Child A exits the bathroom and goes to his cubby and gets his coat. -Child A stands at the playground door inside the classroom. -A parent opens the classroom door to go inside with his child and Child A walks out to the playground.
