Compliance Inspector (CI) JD Greer conducted an unannounced investigation of the allegation that Caregiver Alyna "Loni" Dale slapped Child A (5 years old) in the face. The allegation is substantiated based on the following information:
5 CSR 25-500.182(1)(C)3. which states, "Only constructive, age-appropriate methods of discipline shall be used to help children develop self-control and assume responsibility for their own actions."
AND
5 CSR 25-500.182(1)(C)7. which states, "Physical punishment including, but not limited to, spanking, slapping, shaking, biting, or pulling hair shall be prohibited."
AND
5 CSR 25-500.182(1)(C)8. which states, "No discipline technique which is humiliating, threatening, or frightening to children shall be used. Children shall not be shamed, ridiculed, or spoken to harshly, abusively, or with profanity."
On November 7, 2023, CI Greer interviewed Child A (5 years old), who stated Ms. Loni (Dale) is mean to her. Ms. Loni hits her. Ms. Loni hit her in the face yesterday when she was putting on her jacket. It made her feel sad and scared.
On November 7, 2023, CI Greer reviewed a Health Office Visit Report from School Nurse Candice Bondon and observed Child A reports being hit in the head this morning by daycare worker. Child A reported being hit in left eye/brow area. There is some redness in area.
On November 7, 2023, CI Greer reviewed video footage from November 6, 2023, and observed at approximately 9:54:29 a.m., Caregiver Alyna "Loni" Dale is present in a brown t shirt and white ballcap. Child A is sitting on the ground behind Caregiver Dale and is wearing a red long-sleeved shirt. Caregiver Dale can be heard yelling at Child A. CI Greer was unable to determine what Caregiver Dale is yelling at Child A. At approximately 9:54:33 a.m., Caregiver Dale uses her right hand to strike Child A in the face.
