Compliance Inspector (CI) Heather Radney conducted an investigation of the allegation that on Monday, October 30, 2023, the bumblebee room had nine toddlers with one teacher and on November 3, 2023, the bumblebee room had seven toddlers with one teacher. The allegation is substantiated based on the following information:
5 CSR 25-500.112(1), which states: "The following staff/child ratios shall be maintained on the premises at all times:"
AND
5 CSR 25-500.112(1)(A), which states: "Birth Through Two (2) Years. Groups composed of mixed ages through two (2) years shall have no less than one (1) adult to four (4) children, with no more than eight (8) children in a group;"
AND
5 CSR 25-500.082(2)(B)2.B., which states: "For all other group day care homes licensed for more than four (4) infant/toddlers and for all day care centers licensed for more than twenty (20) children or more than four (4) infant/toddlers, the following shall apply:"
AND
5 CSR 25-500.082(2)(B)2.B.(IV), which states: "No more than eight (8) infant/toddlers or sixteen (16) two (2) -year olds shall be in a group;"
On November 14, 2023, director Sarah Starks stated that on October 30, 2023, she and Melissa Britt were not at the facility. She received an email from Erika Milstein-Finn, Elite Start LLC's enrollment specialist, stating that Grandparent A had dropped off Child A and was concerned because the classroom was out of ratio. She called the center to find out how to correct the ratio concern and corrected it. She then called Grandma A and let her know the ratio issue was corrected.
On November 14, 2023, caregiver Clarissa Molina stated that she has been out of ratio one time. She had nine 1- to 2-year-old children by herself. Sarah told her someone was coming to relieve her but they didn't come right away. It was about 30 minutes or less that she was out of ratio.
On November 20, 2023, Grandparent A (grandparent of Child A) stated that on October 2, 2023, Child A's first day at the facility, she arrived to drop off Child A and there were already eight children with one adult, Child A was the ninth child.
